Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the PartyPal mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and PartyPal (“we,” “us,” or “our”).

2. Description of Service

PartyPal is a party planning application that provides tools for event organization, including but not limited to: party planning workflows, budget tracking, guest list management, product recommendations, calendar integration, and social sharing features. The App may include links to third-party products and services through affiliate partnerships.

3. User Accounts and Registration

Some features of the App may require you to create an account. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You must be at least 13 years of age to use this App. If you are under 18, you must have parental or guardian consent to use the App.

4. Subscription and Payments

PartyPal offers both free and premium subscription tiers:

• Free Tier: Unlimited product recommendations, budget tracking, affiliate shopping, and basic planning tools
• Premium Tier ($9.99/month): AI party planning, cloud sync, collaborative planning, share & export, custom themes, and advanced analytics
• Professional Tier ($29.99/month): Everything in Premium plus white-label mode, priority support, client management, and business tools

Subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings.

5. Affiliate Links and Third-Party Products

The App contains affiliate links to third-party retailers including Amazon, eBay, and Etsy. When you make purchases through these links, we may earn a commission at no additional cost to you. We do not control and are not responsible for the products, services, or content provided by third-party retailers. Your purchases from third parties are subject to their respective terms and policies.

6. User Content

You retain ownership of content you create within the App, including party plans, photos, and notes. By using the App, you grant us a limited license to store and process your content to provide the service. You agree not to upload content that:

• Violates any applicable law or regulation
• Infringes on intellectual property rights
• Contains harmful, threatening, or offensive material
• Includes personal information of others without consent

7. Intellectual Property

The App, including its design, features, and content (excluding user-generated content), is owned by PartyPal and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our express written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE ARE NOT RESPONSIBLE FOR ANY PARTY PLANNING OUTCOMES OR DECISIONS MADE BASED ON APP RECOMMENDATIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTYPAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless PartyPal and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any rights of third parties.

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

14. Apple-Specific Terms

The following terms apply to your use of the App on Apple devices:

• These Terms are between you and PartyPal, not Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties or claims
• Apple is not responsible for addressing any claims related to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
